Sounds like the governor is out of adjustment or sticking, It looks like there's a bit of rust in the pics, something may hanging up.

I read the procedure on how to adjust the govener I’ll give that a shot and see can’t hurt at least lol.

Well some bad new the Governor gear is shot. Adjusted to the way the kohler repair manual wants and it just wants to take off i just cut the ignition and closed the throttle by hand. I picked up a 551 blower today so now i am kinda committed to this machine.

Don't write it off yet. When I first got my 2185 running I had to do all of the adjustment several times due to PO "adjusting" things. I ran into the same thing that you just described which was solved by readjusting the throttle cable.
Just to be sure: you adjusted the governor counter clockwise wile holding the throttle lever at carb against the stop (wot) and re tightened it this way?

Yes sir i even adjusted to three time to make sure i didn't mess up i printed the page and kept re reading it. If i feel the gov lever when it starts it doesn't even attempt to pull the throttle close it just goes WOT and stays even it the throttle is the idle position. I'm gonna pull the back plate off tomorrow and inspect the gear.

Hopefully you did not pay a lot for the 1864.
